Return & Refund Policy

This document is issued by Darkium Essentials LLC, doing business as ‘DARKIUM’ (‘we’, ‘our’, or ‘us’). Any reference to ‘DARKIUM’ in this document refers to Darkium Essentials LLC, the owner and operator of https://darkium.us.

At DARKIUM Essentials LLC (“DARKIUM”, “we”, “our”, or “us”), customer satisfaction is important to us. However, due to the nature of our products and to protect against misuse or fraudulent claims, we have established the following Return and Refund Policy.

1. Return Eligibility and Conditions

STRICT LIMITATION: We accept returns only in the case of defective, damaged, or incorrectly shipped items.

To be eligible for a return under these specific conditions, the following must be met:

  • Time Limit (Period): You must initiate a return request within 7 calendar days from the date of delivery.
  • Item Condition (Mandatory): The item must be unused, unwashed, in the exact condition that you received it, and in its original, undamaged packaging. All original tags, labels, and protective seals must be attached and intact.
  • Proof of purchase or order confirmation is required.
  • We do not accept returns for items that have been used, altered, or damaged by the customer.

2. Non-Refundable Items, Fees, and Final Sale Products
Due to health, hygiene regulations, and the nature of certain products or fees, the following are exempt from refund eligibility:

  • Shipping Fees: The original cost of shipping paid by the customer is non-refundable under all circumstances, except where the return is approved under Section 1 due to our shipping error, damage, or product defect.
  • Used or opened items such as bath accessories, soap dispensers, sponge holders, or similar personal-use products.
  • Final Sale Items: Items purchased on sale, promotion, or clearance are considered final sale and are not eligible for returns, exchanges, or refunds. This rule applies regardless of the discount amount

3. How to Start a Return (RMA Required)

  • Start Your Return Request: To begin your return, please email customer service at contact@darkium.us to request a Return Merchandise Authorization (RMA) number. To help us process your request quickly, please include the following:
    • Your order number.
    • The item(s) you need to return.
    • The reason for the return (remember, returns are accepted only for defective, damaged, or incorrect items as outlined in Section 1).
    • Please attach clear photo or video evidence showing the damage, defect, or the wrong item you received.
  • Review and Authorization: Once we review your request and the supporting documents you provided in Step 1, we will verify if your request meets the requirements of the Eligibility for Returns in Section 1. If approved, we will then email you your unique RMA number, the specific return shipping address (located within one of the contiguous US states), and a prepaid shipping label.
  • Packing Instructions: Please place the item securely in its original packaging, including all accessories, parts, and documentation. Crucially, please write the provided RMA number clearly on the outside of your package. Shipments received without a visible RMA number will unfortunately be rejected and returned by the carrier.
  • Final Step: Shipping: Please use the prepaid label provided to mail your return to the authorized address. The item must be shipped back within 5 days of receiving your RMA number to ensure proper credit processing.

4. Inspection, Processing, and Refund Issuance

  • Inspection and Verification: Once your return is received at our facility, our team will conduct a thorough inspection within 3 to 5 business days to verify the following:
    • The item matches the description and evidence (photos/video) provided in your original RMA request (Step 1 of Section 3).
    • The item is unused (outside of the reported defect/damage) and is in its original packaging with all tags intact, as required by Section 1.
  • Refund Approval (If Approved): If the item successfully passes inspection and the return is approved, we will notify you and process the refund to your original method of payment (credit card, PayPal, etc.).
    • The refund will cover the full purchase price of the item. If the return was approved due to our error (defective, damaged, or incorrect item), the original shipping costs will also be included in the refund.
    • The refund will be completed within 3 to 7 business days after the notification of approval. We cannot issue refunds to a different card or account. (Please note that your bank or credit card company may require additional time to post the funds to your account.)
  • Return Rejection (If Rejected – Your Protection Clause): If, upon inspection, the item does not match the evidence provided, shows signs of unauthorized use/damage, or violates the eligibility terms of Section 1 and 2, the refund will be rejected.
    • Customer Responsibility: In the event of a rejection, we will notify you immediately. The customer is solely responsible for the cost of having the rejected item shipped back to them.
    • Final Disposition: If the customer fails to arrange and pay for the return shipment of the rejected item within 14 calendar days of the rejection notice, the item will be considered abandoned property and will be disposed of without any further obligation for a refund or return.

5. Order Management and Right to Cancel

While we strive to fulfill every order accurately and completely, we reserve the right to manage our obligations in case of unforeseen circumstances that affect inventory or fulfillment.

  1. Correction of Errors (Referencing T&C): In line with our Terms and Conditions on Errors and Omissions, the website may occasionally contain inaccuracies regarding product pricing, descriptions, or availability. We reserve the right to correct any errors or cancel any order at any time before shipment.

  2. Grounds for Cancellation: We reserve the right to cancel an order and issue a full refund in cases including, but not limited to:

    • Inventory Issues: The item is suddenly out of stock, unavailable, or discovered to be damaged after the order was placed.

    • Pricing or Description Errors: The product was listed at an incorrect price, or the description, image, or title contained a significant mistake.

    • Fulfillment Issues: Complications with payment processing, shipping partners, or suspected fraud.

  3. Customer’s Sole Remedy (Limitation of Liability):

    • If an order is cancelled for any reason under this policy, the customer’s sole remedy will be a full and immediate refund of the purchase price and any original shipping charges paid.

    • DARKIUM will not be responsible for any additional compensation, damages, or losses incurred due to the cancellation.

6. Exchanges
We do not offer direct exchanges for items. If you require a different item, size, or color, you must follow the standard return process (Section 3) to have the original eligible item inspected and refunded. Once the refund is successfully processed, you may place a new order for the desired item at your convenience. This ensures our inventory accuracy and adherence to our strict return conditions.

7. Limitation of Liability and Warranties

  • “As Is” Basis: All products are sold on an “as is” and “as available” basis. Except as expressly stated in the manufacturer’s warranty (if any), DARKIUM makes no representations or warranties of any kind, express or implied, regarding the operation of this site or the information, content, materials, or products included on this site.

  • Disclaimer of Warranties: To the full extent permissible by applicable law, DARKIUM disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

  • Limitation of Liability: You agree that DARKIUM shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from the use or inability to use the products purchased from our store, including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses. Our liability is strictly limited to the purchase price of the product.

We reserve the right to modify or update this policy at any time without prior notice.
